What will happen to 498a case if couple agrees for divorce
09-Jan-2023 (In Divorce Law)
I am fighting 498a case against my husband. But its already been two years and no results have come so far. Hence I am tired of the slow judicial system and wants to divorce my husband. Will agreeing for divorce affect my 498a case? I honestly have no interest in following any 498a case or divorce case. I just want to end all this. What should I do?
P.S. I have a genuine case. Only stated facts and no lies. My husband mentally tortured me for dowry but now he is playing victim, taking advantage of the general idea that 498a cases are mostly false. Personally I just want to end all this and start fresh as I have no faith in India's slow and inefficient judicial system.
If your husband also agrees then according to me you both should go for mutual divorce as it is quick and you can start fresh after maximum of six months. You can always settle the 498a case and quash the FIR in the High Court.

that if you want end all these cases then you should suggest your husband to take divorce by mutual consent. if not possible then you can take divorce decree by contested divorce....498a is separate issue....u can suggest him ...if he will take divorce by mutual consent...then you will him quashing of 498a

Indian judicial system is not slow, it rather side effect of virus etc. Anyways, if u want to divorce your husband then plz let us know whether you want to go for mutual or contesting the same. In case u want 498A to be over then u can go for quashing at high court ..however there are other legalities to understand on safer side ..plz b in touch
