What to do in that situation kindly help

I married last year as per Hindu marriage act now my wife left my home and her parents now threatening me and my family to take mutual divorce give us money otherwise we will file cases against you in the court..what to do in this situation?

Hi
No marriage can be dissolved before a year of marriage. Secondly, in case your in laws are threatening you. You need to immediately take action and file an NCR at your nearest police station.

You have to decide whether you want your wife to come back to your home or whether you want a divorce from your wife.
Divorce can be obtained either mutually or through contested divorce.
However if divorce is contested, there are only specific grounds on which divorce can be obtained.

you can proceed before hand and file a petition for divorce on the ground of cruelty.
in case you wish to proceed with divorce through mutual consent you can always try and reach a minimal amount that is acceptable to both the parties.

As you married last year and now she is living separately from first it is her legal duty to stay with you in the matrimonial home and if she do not do this you can file a case of Restitution of conjugal rights u/s 9 of HMA

First of all you must file a written complaint with the police station of your area and mention all your grievances. And if the behaviour of your wife is intolerable towards you then you can always file a divorce petition against her. For more legal assistance I am just a call away.
