1.know your jurisdiction ..place of marriage..lady partners residence...both of you last resided together.
2.Ask if it ia with his or her full consent 3. If alumony required go for only notarised MOU.
3. Make a draft.ask divorce lawyer.under which section you will file your case if soecial marriage does not attract.

Husband and wife must be living separately for last one year. Then only you can file a case for divorce Mutual divorce. In that case a joint petition has to be filed before the Family Court praying for Mutual divorce. On filing a six month date will be given. After that within next one year or on any date fixed within that period both the parties shall have to appear for a decree for Mutual divorce. If anyone remain absent or withdraw consent no decree can be passed. If you have any issue at all you should consult an Advocate.

The first condition to be fulfilled for filing fivorce by mutual consent is to stay separately for at least six months
Thereafter both of you have to file a mutual petition and after six months you get the decree of divorce

For mutual Divorce both the husband and wife have to file a consent divorce case in the family court .The court will hear both the parties and on being satisfied pass appropriate order.
Both the parties need to put their mutual Divorce terms before the learned court.
