What if my husband don't receive summons willingly ?

Hello My husband is government employee in defence , he was troubling me and a minor infant, now if he doesn't receive summons of 125 crpc willingly , and as he is in Bangalore and I'm in Delhi , than what will happen of my case , will my child get justice, we will be sending on his ofc address, coz accommodation he vacated and took new one which is not in my known , and his father did permanent injuction but I'm fighting that too . Please suggest what will be remedy , I ha e his salary slip and all account details.

you can get the summons serviced through what's app and email as well. as you're saying that you have his office address, you can send the summons on the office address and just to be safe send the summons through post on the parents address as well.

yes you will get justice in maintenance coz he is a govt t u send notice to his office address or u can send summon through wats app if he doesn't come it will be exparte order against him your case is genuine justice will not be delayed

Hi
You need to request the court to accept the service of summons by all means possible and then email and send the summons via WhatsApp and email. And then file an affidavit for completion of service. Feel free to discuss further.

Hi ma'am
You can send the summons to him on his office address, wherever he is posted. You can mention the case details as well in a short letter addressed to his CO. You could file an amended Memo of Parties in your petition to add his office address.

Hello, if he is deliberately avoiding the service, then an alternative service can be done through whatsapp and email. Apart from that service can also be done to the department where he is working or at the Headquarters where he is delegated for duty. For permanent injunction, you are required to get a residential order under section 17 PWDV act so that their case becomes bleak.

Your husband is into government job so you have to send summons to the headquarters and the department he's working at… because the government department cannot deny that he is not the employee of that particular department and you can submit one affidavit in the court that this is his department and he is intentionally avoiding to come and then court can accordingly pass ex-parte degree in your favour …u can also send summons to his WhatsApp n email too … once the ex-parte is ordered ..u can attach his salary for maintenance…please be in touch thank you

1. If your husband has not received summons you have to update his latest address to the court and get summons served again.

2. If you are unable to trace him, file application in court for substitution of service through publication.

3. If your husband refuses to receive summons, the court will issue warrant against him.

if the above process is followed, your husband will come to the court following which you can proceed with case filed against him.

Since it’s a criminal case the court can issue arrest warrants against your husband if he doesn’t appear after receiving the summons as nowadays everything is online and you must be directed to forward your petition through email and WhatsApp also. For more legal assistance I am just a call away.
