What do you say about filing for dissolution of marriage under sma 25 without conducting an impotency test . Can I put an IA and ask the court to direct for impotency test

Dear Madam, You can file application under Order 26 of Civil Procedure Code to refer your husband for potency test after filing Divorce case. Thus, you can establish impotency of your husband moreso your affidavit evidence will be believed since no women in India swears on oath and say that her husband is important.

the marriage can be dissolved by mutual consent. If both the spouse mutually gives their consents to end the marriage, they can take the divorce. The Hindu marriage act now permits divorce by mutual consent under section 13B .
