What action against Husband abandoning me and kids born from a donor?

HiI got married  in 2009.later I realised that he was in debts therefore he was living on my salary.occasionally he used to ask me to get money from my brothers. I had to take 2 personal loans to clear his never ending debts. husband was not earning enough. Later when we decided to hv a family I realised he has undesended testicles (no testicles).this came as a shock to me.i felt like I have been cheated. Later we both decided to start a family with a help of donor. After few IUI in Bangalore I moved to Hyd for IVF in 2012.The entire IVF process took almost 2 years.kids wr born in 2014.Husband started behaving indifferent.he nvr took kids close to him.when I went to Bangalore he asked me to leave the house saying they are not his children and he will not raise them.SInce then he nvr looked at kids.I didn't go back to him because I don't believe he will tk care of my kids.Now he wants divorce as he wants to remarry or move on.i earn less than him and I need alimony

You did not mentioned whether you need divorce. You need only maintenance for your kids and alimony. If you want alimony, why don't you file the petition first with the problems you faced in your marital life.

Hi,
It looks like your husband married you only for money.
Even if the child are born through ivf, your husband will be the natural guardian and father for the children.

Children are entitled to maintenance from their father.
You need to file the following cases
1) maintenance case - claiming maintenance for you and your children.
2) dowry case- Since you have taken personal loans to fulfill the financial demands, it is construed as dowry and hence 498a will be applicable.
3) let your husband settle you and your kids in all financial and property aspects and then probably you may grant consent for mutual consent divorce.
