We are Hindu family. I and my wife are living separately since 2 month due to some dispute. Wife went to hometown alongwith 2 daughters of age 11 years and 4 years before the annual examination of daughter in 6th standard and now exam is going on and my daughter has not come and nor appeared in the examination. My wife is reluctant to children's education and there proper nurturing. Can I get the child custody without judicial separation. What is the probability to get custody of my daughters. On what ground I can file petition for this.

Well, you cannot get a Child Custody without opting for either Judicial Separation or Divorce. In order to seek Child Custody, you need to file a Petition in the concerned Family Court. If you won't succeed to get Child Custody, at least, you will get the Visitation rights to meet with your child.
