Want to convert contested divorce case into mutual divorce case

Hi i want to know the court fees for converting the contest divorce case(with alomone and maintainence petition) to mutual divorce, please tell me what will be court fees axactly. thanks

Hi,
to convert contested divorce you need to amend your petitioner from Sec. 13(1) to 13 (B) and withdraw all the adverse allegations by converting it into simple mutual divorce petitioner. Once the amendment is allowed you need to move your evidence affidavit to that effect. The alimony or maintenance can be mentioned in the mutual divorce petitioner which is to be filed after the amendment petitioner is allowed.

As such there wont be much court fee, however since the process is complicated a lawyer would be helpful in sailing through this situation.

It is always good to ask your advocate regarding court fees. You need to put separate petition for mutual divorce. You need to withdraw contested divorce case stating the facts. It is better to go for mutual divorce.

Dear,

No court fee is required to be paid to the court for converting the contested divorce case to MCD. You can simply appear before the court with an amendment petition through which you plead the court to convert the contested divorce case to MCD or you can ask the court orally to convert the contested divorce case to MCD. The court will then inquire with your spouse if he/she doesn't have objection for the same. If your spouse if also ready for MCD, the court will grant MCD.
