To advise you properly, I need to first understand whether both parties are willing to separate or not. Mutual Consent Divorce – This is possible only if: Both husband and wife agree to divorce, and They are ready to settle all issues (alimony, maintenance, child custody, property, etc.) Contested Divorce – This applies if: One party does not agree to divorce, or There are disputes regarding cruelty, dowry, maintenance, custody, etc.

There are basically 2 way of divorce. One is mutual divorce and other is due to different grounds. In mutual - both the parties agree for divorce but in other one party agree other dont. In some cases divorce cases are accompanied with some other applications and petition for maintenance and settlement between the party. For better understanding you should talk to an advocate.
