Want divorce from wife, facing cruelty, money extortion

05-Feb-2023 (In Divorce Law)
this is my second marriage. After 4 months, wife started physical abuse, suicide threats, money extortion, attempts to kill me, forcing to cut ties with my family (mother) and other cruelty. i have no children from her. i have all the proofs (videos and call recordings) to prove above issues. Now i am staying out of my home since 5 months with my son (14Y). she is staying with her son in my house. I want divorce. Do i have to pay alimony if i prove her cruelty? If yes, how long i have to pay alimony?

no u not need to pay Misuse of Dowry Laws, Domestic Violence Act and 'Sec: 498-A' of IPC by wife against husband and in-laws of husband through lodging false complaints. Desertion by wife which means wife deliberately intending for separation and to bring cohabitation permanently to an end

Dear queriest, as per your query you have mentioned about you have been facing cruelty from your second wife and also staying seperate since 5 months from her, if such is the case then you can file divorce under the grounds of cruelty and desertion and the question of maintenance that we can prove before the court that she is cruel in the matrimonial relationship and therefore we request court to not to grant any sort of alimony or maintenance to her. for more information about the same kindly contact me.

Hi you can get Divorce on the ground of cruelty if proved. also if the wife is earning sufficient for her maintenance then you will not have to pay her maintenance. your son is your responsibility till the age of his 18 years and if maintenance order passed by the court then will have to pay that maintenance for her lifetime or till she remarry.
