Want divorce from my husband who married me when I'm 16 years old.

I am 23 year old.I have 5yr old child.me and my child is separated from my husband and living with my parents.I got married at the age of 16 and i was forced by my parents and relatives (my husband is my blood relation) to got marry my husband who is 14 years elder than me.since I was 16 I had any knowledge about marriage,but he misunderstood that I had any affair so I don't want to live with him.he made many problems regarding my studies,job and he told he want a wife only to serve him like a servant.but when I protest against him he tried to make an image that i had an illegal relationship and he is innocent.6 yrs in our marriage life we live together only for a period 2 years as a whole.I left him before 1 year.now I want a divorce from him.but he can't willing to divorce me challenging he would ruin my life.I need a advice.and I want to kono of I petitioned against him what should I do and how long it takes to get divorce from him
You can file a petition to nullity of marriage for the reason of your marriage taken place when you were minor. At the same time, you can file the petition on the ground of cruelty also. If the divorce case is contested by your husband then it will take atleast 3 years to get an order. If you plead for nullity of marriage you have prove that the marriage was taken place when you were minor by producing the sufficient document to prove your age.
