Want a divorce from spouse as she

Please advise me that can I get divorce from spouse as she is not living with me since a year . If yes then what is procedure for that?

Hello, sir /madam u can get Divorce Divorce is permitted only for a grave reason otherwise given other alternative. The Hindu Marriage Act is based on the fault theory in which any one of the aggrieved spouses (Section 13(1)) can approach the court of law and seek the remedy of divorce.

If that is the only ground of not living together since, you will have to wait another year. As the period for filling divorce on the ground of desertion is two years. If there is another ground you can discuss on call.

Dear queriest, as per your If you want divorce from your spouse and she wherein she is not living with me. you can send legal notice regarding you proceedings for divorce on the grounds of desertion. and if she is ready for mutual consent then it is well and good for you and if not then you go for litigation. for more information about the same kindly contact me
