Subject: Domestic Violence, Marital Separation, and Entitlement to Alimony Based on the details you have shared regarding your marriage, the domestic violence, and your current financial and emotional situation, here are your legal options and potential steps you can take to protect yourself and seek justice: 1. Protection Against Domestic Violence: Since your husband has been physically abusive, including the incident where he tried to strangle you in July, you are entitled to protection under the Domestic Violence Act, 2005. You can approach the Protection Officer or a lawyer to file a complaint under this Act. Under this law, you can seek immediate relief such as: Protection Orders to prevent your husband from harming or contacting you. Residence Orders to ensure you continue to live in your marital home or in safe accommodation without being evicted by your husband. Monetary Relief for medical expenses, loss of earnings, and maintenance. Compensation Orders for the pain and suffering caused by domestic violence. You do not need to be financially strong to file a case under this Act—the law is designed to protect women like you who may be in difficult financial situations. 2. Right to Alimony/Maintenance: As you have been married for 7 years, you are entitled to claim maintenance and alimony under Section 125 of the Criminal Procedure Code (CrPC) or under the Hindu Marriage Act, 1955 if you decide to proceed with a divorce or even if you live separately without divorce. Given that your husband is not working currently, the Court will assess his previous income, assets, and any potential earning capacity while deciding on the amount of maintenance You mentioned that you both own a flat together. This joint property can be considered by the Court while deciding the quantum of alimony or settlement during divorce proceedings. You can receive interim maintenance during the course of the legal proceedings to support you financially until the case is fully decided. 3. Grounds for Divorce: If you choose to seek divorce, cruelty—both physical and mental—is a strong ground for divorce under Section 13(1)(i-a) of the Hindu Marriage Act. The repeated verbal abuse, threats to throw you out of the house, and physical violence (such as the choking incident) constitute cruelty. Your husband’s failure to take responsibility, including not working after COVID, and constant harassment about not having children are also factors that contribute to mental cruelty. You can file for divorce on these grounds, and

Ji Bilkul aako Alimony milegi, magar iske liye aapko Court dwara Uchit Dharao ke andar yachika lagani hogi. Agar aap aisa karne me nakam rehti hai toh, aape liye hee musibat aage khadi hogi. Sahi Advocate chune ke liye, Jo aapka Case free me athva kum rupayo me lade, uske liye, aap legal aid centre ka bhi Rukh kar sakti hai.
