Urgent Legal Advice Needed: Arya Samaj Marriage, Abuse & Harassment

16-Mar-2026 (In Divorce Law)
My sister (25, MBBS intern in India) had a secret Arya Samaj temple marriage about a year ago. They received a temple certificate but never registered the marriage with the government. The man has since physically assaulted her and is now harassing and threatening to send marriage photos to our conservative parents if she asks for divorce. What legal options does she have to stop harassment and end this situation?

Registration of marriage is not mandatory in India. Also if the marriage has not followed the Hindu ceremonies, mere certificate of arya samaj would not make the marriage legal. However even if the marriage is not legal, she has independent legal right to sue him under Domestic Violence Act. For better understanding feel free to connect. Thanks

Non registration of marriage with the concerned authorities does not make the marriage invalid. a marriage in the Arya Samaj Temple is a valid marriage. you have not mentioned which religion your sister and her husband belong to. in any case if your sister wants to get out of the marriage she has to file a divorce in the concerned Court. if her husband is harassing and physically assaulting her a complaint can be made to the concerned police station. please feel free to contact me in case of any queries.

If your sister went through a marriage ceremony in an Arya Samaj temple and obtained a temple certificate, the marriage can still be treated as valid if the essential marriage rituals were performed, even though it was not registered with the government. In view of the physical assault, harassment and threats by the husband to circulate marriage photographs, your sister has the right to approach the court to seek divorce on the ground of cruelty. At the same time, she can also file a police complaint for assault, harassment, intimidation and blackmail, and seek legal protection to restrain him from contacting or threatening her. It is advisable that she preserve all messages, photographs and evidence of threats, as these will help in both criminal action and matrimonial proceedings. This legal action can both stop the harassment and legally bring the relationship to an end.

All you can do file a complaint to your nearest police station and women cell and file a petition before the family court for divorce As the RS Samaj marriage considered as a legal marriage under section 7 so what do you have to file a complaint at first against the person and simultaneously file a divorce petition

She can file a regular complaint of harassment and abuse in case you do not wish to file for divorce. Though it is highly advisable in the present situation that you file for a divorce under the provisions of Section 13 of The Hindu Marriage Act
