28-Aug-2024 (In Divorce Law)
Can a wife video record unauthorised unconsented intimate relationship with husband at her matrimonial home as evidence to be put before Hon'ble Family Court to show that they are having relationship when they both are fighting various (Divorce 13(1)(ia), 498 A, 504, 506 IPC, Maintenance under Section 125 Cr.P.C., DV Act) cases in courts of law.
No video recording of intimate relationships are not allowed in divorce proceedings .The Supreme Court in Puttaswamys case has emphasized the law relating to right to privacy. Therefore the evidence even if produced in the form of CD or pendrive in family court will not be appreciated and allowed . Contact me for any help.
