Transfer of Divorce case from Vijayawada to Pune

Dear. I am a Hindu and got my daughter married in AP. Due to harassment she filed for divorce in Vijayawada court to expedite matter. She stays in Pune and now she is struggling in attending her case due to long distance 1000 KM's. The husband staying locally is having a gala time and due to delay my daughter is going through physical and mental harassment since at times when she reaches she finds either the Judge is on leave or the other party is willingly absconding from attending to delay the case. Is this a proper case for Transfer of case since the aggrieved is further under torture. Ram.

Dear Sir,

Your daughter has to file a transfer petition in the Supreme Court under Section 25 of the Code of Civil Procedure-1908 to get her divorce case transferred from Vijayawada to Pune. The Supreme Court is normally quite liberal when it comes to transferring cases for the convenience of wives.

Hi
You can always seek transfer of a case to pune depending on place of residence.
However you have to approach the supreme court and file a transfer petition u/s 25 of Civil procedure code (as transfer is between 2 states) and obtain the transfer.
Alternatively your daughter can take permission from court to be present through video conference also.
