Transfer applay and Stay is pending since one year in High court

Namasthe Sir,my sister case, we have filed FIR on my sister Husband and his sisters who have taken dowery and harsment made, and amount 2lakh transfered before marrige 20 days to his sister account, and case is in District court and agaisnt that stay appliction by her husband in high court on his sisters, we have recieved notice same we replyed by our lawyer, 1)now we want to take transfer that case to where my sister and my parents lives, 2)Stay is one year over can it takes that much time,

You may seek transfer of the criminal case only if there are valid legal grounds such as serious hardship safety concerns threat to the complainant or witnesses or other exceptional circumstances Mere convenience is generally not enough A transfer petition can be filed before the appropriate High Court or Supreme Court depending on the circumstances As regards the stay there is no fixed time limit A stay continuing for one year is not uncommon if the High Court has not finally heard the matter Your advocate can file an application for early hearing or for vacating the stay by pointing out the delay and the hardship caused to your sister and request the High Court to dispose of the case at the earliest
