TO KNOW ABOUT CLAIMING OF MAINTENANCE

Dear Sir, My son who is an IT Engineer in MNC had got married last year in month Dec.2020. Before five months dispute occured between the couples & wife of my son filed the case in court vide complaint titling 125 CRPC claiming monthly maintenance of Rs.50000/= per month although she possess MASTER DEGREE IN PSHYIOTHERIPIST & is doing service in a big company with salary of Rs.20000/= per month. She has flat in her name worth Rs.600000/=. Till today both couples have no kids. Whether she is entitled for Maintenance or not & if yes then how much should be the maintenance.

Hi ,usually a wife is not entitled for maintenance if she is capable of earning and maintaining her monthly expenses ..As a interim maintenance the court may impose a minimum maintenance amount till the final disposal of case ..The interim amount may vary 5-10 k ,however it is totally upon the discretion of judge ..
