First Motion Petition - Both husband and wife file a joint petition with mutual consent in family court. 2. Cooling-off Period - Law requires a 6-month waiting period after the first motion to allow reconciliation. However, the Supreme Court has held this 6 months can be waived by the family court if: The marriage has already broken down beyond repair. Both parties have been living separately for at least 1 year. All settlement terms (alimony, custody, property, etc.) are already agreed upon. 3. Second Motion Petition - After (or with waiver of) the cooling period, both parties appear again befr judge.

Well, I can assist you in seeking Mutual Divorce, however, if you need Maintenance also, your Husband may deny in Court or before that stage itself to not let you seek Mutual Divorce from him to avoid the burden of paying Maintenance and Alimony, which may be or are your terms and conditions to seek Mutual Divorce!

Mutual consent divorce normally takes 6 months, but since you are separated for over a year, you can request the court to waive this period. Settlement terms must be properly recorded, and you can claim maintenance or a lump sum for your financial needs. Do not agree without a clear written settlement to protect your rights.

No you cannot take divorce in 1week, the whole procedure will take at least 6 months depending upon the case, there will be another 6 months cooling off period, getting divorce in Indian laws, is no joke and cannot be filed on the same ground again and again, if you are facing financial issues you can seek interim maintenance for your survival, but even with filing of an application for waiver of 6 months period it would still take 3-4 dates for divorce, excluding the time and sessions of counselling before the first date
