Time given for reply to divorce notice
08-Dec-2024 (In Divorce Law)
My husband filed divorce petition and I have received court summons and engaged a lawyer, who had filed vakalat in last court hearing.
1. I want to know how much time is given for me to file counter to the divorce petition. (Till how many hearings can court allow to file reply to this petition.
2. Is it compulsory to attend court hearings regularly or will my lawyer suffice my presence for one or two hearings for which I am absent.
I want to extend this divorce as much as possible. Plz guide
you have 30 days to 90 days for filing ws. after that you will have to file delay condonation application. if this is in Mumbai the matter will. be refered to marriage counsellor and then the limitation starts. in civil case you need not always be there. though in family case presence of parties are sought, but it is also exempted.
Well, you will get 30 to maximum 90 Days within which, you have to file a Written Statement before the concerned Family Court, Bandra in response to the Divorce Petition filed by your Husband. It is not necessary for you to attend the Hesrings regularly, your lawyer can duly represent you in Court and do arguments on your behalf. However, during filing, you have to remain present for Notary or Attestation and then during the time of evidence stage, your personal attendance for getting your testimony recorded, you need to attend Court personally with your Advocate
