Summon not received only message received

Hi, My husband has filed a divorce in Maharashtra and I stay in Delhi. Though the court has given the hearing date twice that I received over through text message from court but the summon is not received yet. Is it mandatory to appear before the court without getting a summon as I hardly left few days to book my ticket

Well, it is not mandatory for you to remain present on the next date, as your lawyer, which you hire, can represent you on the next Date in the concerned Family Court, from which, you have got the notification to appear via text.

Summons is issued by the Court to the party. However, it is strange that you haven't received the summons but a message from the Court. You usually don't get message from the Court. Feel free to contact me for seeking any legal assistance as regards the same.

Yes please do appear in the court as you have the knowledge and the might take ex parte decision in the matter Have to check the matter for the notice report and then can confirm Feel free to call me for assistance in Pune court

Considering you are at Delhi, the court might have sent the summons on your email or WhatsApp. Re-confirm it. Summons might also have been sent to you through India post or private courier. Or thru the local court where you reside. I would be advisable to appear before the Court at earliest to avoid passing of any adverse order against you.

You need to see whether the summons were served by any other means and have the other side filed the Affidavit of Service. If the Affidavit of Service is filed then you should appear before the Hon'ble Court by yourself or by lawyer.
