STAY ORDER FOR INDIAN DIVORCE CASE AND FREEZE THE BANK ACCOUNTS

legal question I filed for divorce against my abusive spouse in the USA and later he filed for divorce in India in order to save money , He escaped from US and moved all the assets to India and we have two children out of marriage and he left us abandoned for years.Now i want to stop the proceeding in Indian divorce as the first divorce petition was already filed in the US and the ex husband appealed to serve under hague and it is with central authority now,in New Delhi.
Can i get a stay order or freezing of the bank accounts till a judgement is received in the US Courts ?

Yes, you can contest the case filed in India by your husband and get it dismissed or get an injunction to stop the proceedings in India. Freezing of bank accounts will be difficult. But you can claim maintenance within the divorce petition filed by your husband. As the case filed by your husband is the subsequent one, you have a pretty good chance.

divorce proceedings at India and USA are different. Indian law is rigid but us laws are not. Divorce filled at Indian Court should be contested by you and no way to stay the divorce proceedings at USA no usa courts accept the petition
