State Of Jurisdiction In Husband Wife Dispute

Hi. I live in Sirsa, Haryana and I got married last year in April to my wife who was living in city Ellenabad in their own house, which is also located in Sirsa district. My wife along with her family was living in Ellenabad from the past 3-4 years and previously they belong to a village near Bundi city, Rajasthan. Even the address of aadhar card on my in-laws are of the village near Bundi. We had disputes in between us but recently we had a baby girl of 2 months. My wife lied to me that her mother is sick and she is going to ellenbad for 4-5 days, but she along with her family went to their previous location of village near Bundi and in nearby police station filed a false complaint against me for 498a(domestic violence, dowry etc) and the asi is not providing me the complaint copy as threatening me to lodge FIR. My father is bed ridden and mother has no vision. Is there any chance that this case or any other case be transferred to my city?

hello as per your query your case legally can't transfer from Rajasthan to Haryana but you can file case under section 9under hma against your wife, For further help and legal guidance you can contact with me Adv Jitender Singh

Hi Sir, Yes there are chances of getting the case transferred if you state good reasons before the court of law. There could be possibility of transfer in neutral place not being her home or yours. Please call for further clarification on the issue Thanks Adv Dr Preeti

instead of asking for shifting of case filed by your wife at Bundi to Sirsa you should file and cross complaint against your wife in Sirsa. they have deliberately chosen to file complaint over there to cause trouble to you and your family
