Son’s custody will be given to father or mother ?

I have a son who is 2.7 years old. If I apply for divorce to while will child custody go? I have this question as it’s a male child. Custody will be given to my husband or me ?

till age of 5 mother wil be legal guardian for kids so if you apply for divorce you can apply for child custody also so that your son will be with you only you can get orders from court for permanent custody of child

Dear Sir Normally father will get custody after 5 years. You can initiate and show to the court that mother is acting adverse to the interest of child. Welfare of the child is most considered factor which you have to establish to the court. You will get custody if you establish that mother is not interested to rear the child properly.
