sexual relation and child visit permission

Sir, my wife is leaving at her mother home since 5 years and since than we have no sexual intercource and she does not alllow to meet my child. Also she has did 498 dv and all. Can i ask permission in court for sexual relation with wife and meet my child. Because without sexual relation a person health mental condition affect.

Well, you can file a case of Restitution of Conjugal Rights under Sec 9 of the Hindu Marriage Act, 1955 in order to call your wife back, to restore her relations with you as a wife including physical relations. However, order passed by the Court under Sec 9 of the Hindu Marriage Act is not binding upon Wife. If the Order goes in your favor and she does not co operate in restoring physical relations with you, then, it can become a ground for you to seek Divorce.
