Settlement in Mediation - District Court

Our case (complaint) was settled mutually in February 2024 wherein Respondents agreed to pay X amount by April first week but they are running away from the terms and conditions and not signing the first motion affidavit and they come up with different excuses in the court. 3 Execution applications are already pending in the court and not paying around 3-4 lacs ( arrears) , now we have heard that their lawyer is suffering from Brain Hemorrhage, we are not sure what should we do in this case ?

Seek a second opinion from an Advocate and act as per his advise. If your husband is not adhering to the terms of mutual settlement you may apprise the same thing in the Court through a lawyer and pursue the case on merits.

You can always approach the court and file your affidavit regarding the harassment the respondent is doing by not finalizing upon the terms and conditions and it also attracts the breach of contract. And as far as the execution petition is concerned the amount will keep on adding.
