Separated from a year how can I claim for maintenance

Dear Sir/ Mam, My husband left the house last year on 17th May 2015 as we he didn't want to stay in my Mom's house. Since then we are staying separately. We would meet outside or sometimes he would come home. All efforts to take a house on rent and start afresh have failed. Every time, we quarrel or argue he stops talking to me completely, doesn't respond to calls or sms. His fly too does not intervene to make things better. I am 39 years old already and dont know the way forward. He hasn't paid a rupee against my maintenance in the last 1 year. Please advice.

You have remedy under 125 cr pc to get maintainance from ur husband , you need to consult a lawyer , for this , and you can try to make life better by creating understanding . The separating choice is always there .

I suggest you to file a maintenance case before the jurisdictional family court. Also you have an option to file a Domestic violence case before the jurisdictional magistrate court claiming protection of shared house hold and better maintenance.

Staying in u r mothers house is not a compulsion, if this is the only reason for u to get separated, dont worsen the situation, pl. see for a rental house and settle down or try to convince u r husband and see for a house which is close to u r mothers house and start living together. If u seek maintenance u'll be spoiling u r relationship with your husband so considering u r age better join as quick as possible.

it is very simple if you already obtained order of maintenance from the court you can file recovery petition against your husband if no order with you you can file fresh petition for maintenance against your husbant

Ans: since you have been making efforts to patch up, it is advisable to called by an advocate to mediate the matter between the parties, so that the marriage survives
