Dear Madam, Even though the wife cannot claim ownership, the court must consider the husband’s income and assets when deciding on: Interim maintenance Permanent alimony (Sec. 25 Hindu Marriage Act) Maintenance under Sec. 125 Cr.P.C. Maintenance under Domestic Violence Act (Sec. 20, 22) The Supreme Court has repeatedly held so.
