Seeking legal help in DV & Divorce case

05-Feb-2023 (In Divorce Law)
Married under Hindu Act. I have filed DV case and my husband filed Divorce case in Thane court. Reason to file DV is extra marital affair, financial, mental & emotional harrasment. We have 7 years old son. I want to know below - 1) Are whatsapp chat messages enough to prove his extra-marital affair ? 2) How do I prove that I was harassed financially, mentally, emotionally? I do not have proof for these harassments. 3) How do I legally find my husband's true earnings, assets legally as he has shown false earnings ? 4) Can I ask for property share in my shared household ? Alternatively can I ask for my son's share in property? The property is in my mother-in-laws's name. My husband says he will not give any share for this house. 5) My husband has shown false mortgage papers on the above property. This property was not mortgaged till I was staying with them. How should I prove that the mortgage papers are false?

First of all do one thing that don't leave that house. You can prove your case easily by filing assets and liabilities declaration affidavit and claim for number of protection orders in domestic violence case. Also file interim maintenance application in divorce petition.

Dear queriest, as per your query you have mentioned about the fact that your husband is not ready to give any share jn the property since he showing fake income and also has mortgage thr property which is also fake. here if we succeed to prove his extra martial affair then we have strong reason before the court to atleast alimony or property share may be passed in favour of your son and also maintenance for you. for more information about the same kindly contact me.
