Seeking legal help

12-Nov-2024 (In Divorce Law)
Against my maintenance case my husband lawyer put stay order and in revert we filed execution case. Finally after some time court announced 6k maintenance to me. Now the amount is 3 lacs. But he stopped coming to court. It’s a ex partee case too. He is not interested to pay maintenance, alimony and divorce too. I am a cancer patient and 15k is approx my monthly medical expenses which I spend. I m stuck in a trap how to move out from this ? What should I do that I get relief? Please suggest.

If your husband is not abiding by the court orders then in execution petition, your legal counsel can seek warrant of attachment or any other effective order as per the facts of your case. Details are to be discussed for better advice. Feel free to contact. Thanks

To enforce the court's maintenance order, you can take the following steps: File an Execution Petition: Seek enforcement of the maintenance order under Section 125(3) CrPC, requesting the court to attach your husband’s salary, property, or bank accounts, or issue a warrant for his arrest for non-payment. Enhance Maintenance: File an application to increase maintenance, citing your medical expenses (e.g., cancer treatment) and inability to sustain yourself. Submit medical records and expense proofs. Criminal Remedies: File a complaint under Section 125(3) CrPC for imprisonment due to his non-compliance. Use provisions under the Domestic Violence Act to claim additional compensation and medical relief. Contempt of Court: Initiate contempt proceedings for your husband’s deliberate non-payment of maintenance. Legal Aid and Support: Approach the Legal Services Authority or Women’s Commission for free legal aid and expedited relief. Many NGOs also assist women facing similar challenges. Expedited Proceedings: Request the court to prioritize your case due to your health and financial burden.

Your case history need to be examined to see what further steps and legal remedy is now available, including record of orders already passed and to what extent they have been complied or not by your husband .
