Seeking divorce when marriage has not been registered

year. Now both of us have agreed to give divorce.our marriage registration has not yet been done.is it necessary to attend the court to take divorce.

I our beautiful India many marriages have not been registered by any one out of 100 only 5 Percent is registered who are intending to go for foreign country as it is very much needed there so in our county there is no need of registration and our court does not ask about it it need marriage photos, invitations copy, address proof showing both residing with Aadhar card, ration card and this is needed and both should bee there at time of filing case and in all dates both should be there if they need divorce.

Yes it is necessary and mandatory to attend court , and you can represent your case through a lawyer, but whenever your presence is required you need to be present the court. However since both have agreed for divorce, a mutual consent divorce can be filed. Please come to my office for a meeting. Thanks for writing

When you have got married is it a arranged marriage or love marriage. Though you might have not done registered it but you must have any proof to show that you are married, hence check about the same if it is arranged marriage you must have invitation card, photos and witness. If you have married in temple you must have photos and receipt given by the priest of the temple. If you have not married in above said manner and in the absence of registered marriage if you don't have issues then it is better to part away peacefully there is no necessity of legal separation for your illegitimate relation. If it is live in relation then a women can seek for compensation by proving the relation before court of law.

When your marriage has been solemnized whether customery marriage or love marriage or register marriage, both of you must knock the doors of Temple of Justice for Divorce by filing a Joint Petition.

Yes, you can proceed mutual divorce without marriage certificate etc., consult and get good advise in this matter, and explain briefly to get early decree. Marriage photos, and address proof etc is to be required.
