Safeguarding Minor Child’s Investments in Context of Divorce/Alimony

28-Sep-2025 (In Divorce Law)
I seek your guidance on safeguarding assets held in my minor child’s name (Mutual Funds, FDs, SB deposits). These were created for my child from my first marriage. After my first wife’s passing, I remarried, and my current spouse is now threatening divorce and alimony. Please confirm that these assets remain the child’s exclusive property and advise legal measures to protect them from any claim.

Under Indian law, any assets (Mutual Funds, FDs, Savings Bank deposits) registered in the name of your minor child legally belong to the child, not the parents. These do not form part of the marital/joint estate and cannot be claimed by your current spouse in divorce or alimony proceedings. As a natural guardian, you manage the child’s financial affairs, but you cannot treat the assets as your own. The child has full ownership, and upon attaining majority (18 years), he/she can exercise full control.

it can be very much protected in your minor child's name and you need to follow few steps and there are plenty of loop holes on your end for which you are scared but if we sit face to face over a meeting i can block those loop holes
