Rights of son if Ex-parte divorce given now husband passed away

I have divorced my husband last year ( got ex-party), as he didnt appear for the case.I have 8 years boy kid.I didnt get anything as alimony also.but unfortunately, my husband met with an accident and passed away last week.There is no asset in my husband name. But his parents are having assets in their name. Will I able to get any money or asset for my son?Please clarify.

I guess you mean 'motor accident' by the term 'accident'. If it is so , You can file a claim petition on behalf of your son under motor vehicles act and get compensation. If the properties are of ancestral in nature you can file a partition suit on behalf of your son and claim share. Before filing such suit send a lawyer notice asking for a partition and try find a settlement in amicable way.

have you quoted cost in your divorce petition? was it simply ex-party order without any cost? without knowing these answer is not possible to your question. . . . .
