Rights in marriage after divorce

I am mother of 2 kuds married for 10 years. My husband is alcoholic, has ED, abusive and emotionally abuses day and night. We are in long distance marriage and he had an affair there. I want to separate but want to know my rights. We married under Special marriage act I am SC and he is Syrian Christian from Kerala

Your rights after divorce majorly depends upon the terms and conditions agreed by you both if you and your husband have decided for a mutual consent divorce. If you want to file a case for divorce against your husband, you can claim your rights before the family court such as maintenance, child custody, interim maintenance, share in property. Dear queriest, as per your query you can file for divorce under the provisions of special marriage act and claim maintenance for yourself and your 2 kids, also on grounds of desertion and cruelty you are eligible to file divorce case on such grounds, for more information about the same kindly contact me.

Well, if your Hubby is having an affair outside and you are not happy with it being his wife, then, you can file a case of Unilateral Divorce to seek Divorce from your Hubby. Before giving Divorce, you can approach Court to seek Maintenance.
