Right for alimony of wife in case husband dependant on parents

Husband is dependent on his parents while wife is in private service. Husband lives in parental house and are 2 brothers with their parents. Can wife seek alimony from husband ? Both party based in Delhi and 'Hindu' by religion.

Yes absolutely wife can claim the alimony from the husband. The factors that the court takes into consideration for permanent alimony for the wife as as follows: A) The status and position of the husband, his income, his assets and his lifestyle B) The reasonable wants of the wife C) The wife's own income or earnings

Yes wife can claim maintenance from her husband and it is immaterial that he is living with his parents or not. Wife can claim maintenance under different provisions of law such as under section 125 Cr.P.C or under section 25 of hindu marriage act or under section 20 of protection of women from domestic violence act, etc.

In cases of this type it is best to leave the case to the better judgement of the judge because cases of this type totally depend on the evidences as are given st the time of hearing and nothing else matters

Alimony is a statutory right given to the wife irrespective if whether the husband is earning or not. A wife has legal right upon the property of the husband only when he has a share in the property of his parents. If the share is not allotted or the share is self-acquired by the father of the husband and he is not intended to part ways to his son them in that case the wife has no right over the property of her in-laws.
