From the facts stated, you already have strong legal grounds. Filing criminal cases, maintenance and DVC proceedings will support your divorce and strengthen your position before the court. The slow progress is mainly due to non-service of summons and the respondent absconding, but the law provides remedies in such situations. You should immediately request the court to take coercive steps such as substituted service, publication in newspaper, and issuance of non-bailable warrants if he continues to avoid appearance. Once the court is satisfied that he is deliberately evading, the matter can proceed ex-parte and the divorce can be granted without his participation. Simultaneously, you may seek recovery of the amount taken by fraud and coercion through appropriate civil and criminal proceedings. Proper follow-up, timely applications and strong documentary evidence will help in securing early relief. Do not lose confidence. With correct legal strategy and persistent action, the case can be expedited and your rights can be effectively protected.
