Reply to Notice Regarding mutual settlement u/s 13B of HMA, 1955

04-Aug-2025 (In Divorce Law)
Sir i am married in Jan 2023 at Delhi, During my preganancy in Sep 23 I left my Husband s home and came back to Kolkata due to mental torture and harassment by my inlaws and husband never took stand for me and got involved with them. After that they(inlaws+husband) visited my parents home multiple times without prior information to take me. But due to that mental trauma I refused to return back. In April 2024 I gave birth to baby girl, still they fight on phone, now they sent legal notice. Guide

They most probably has sent you with a legal notice for Restitution of Conjugal Rights, but if you don't feel the requirement to go to their house then there is no harm you can refuse via replying them back with a legal notice of your own.

you need to clarify the contents of the legal notice they have sent. you have mentioned that there were mental torture, you need to support the claim with documents. If I assume the notice is for mutual divorce, you need to decide whether you want peaceful divorce or you don't want one.

If you want to take legal action then we can help you in filing divorcee case but if there is any settlement you want to do you are allowed. If you wish to return you can. If you want to stay in your maternal home then that option is also valid. You must take decision on whether you want to return or not or want to do any settlement talk.
