Rent Paid claimed in HRA for tax benefits and also claimed in Divorce
18-Dec-2023 (In Divorce Law)
Wife used to pay entire rent from 2012 till 2018 separation. She used to claim HRA for the rent paid in her investment declaration in a Pvt firm for tax exemptions.
Now the same rent is been claimed in divorce petition as a relief.
Can this happen and is there any law that stops the wife from claiming the rent paid and taken hra benefits for tax exemptions and also claim relief in divorce petition
Dear Sir,
It is a criminal offence that is tempering of records etc. You may also file application before the Court to initiate legal action against her for misleading the Court and claiming rents which she had already received from her company. You have to produce all the relevant documents and ask the lower court to struck off her pleadings and if order is not in your favour then you may approach High Court.
Let me be very specific with your question , yes she can the claim, the whole act is done Hindu Marriage Act is done with one purpose to protect the woman in general who are the victims, so yes objecting to it in the court of law will get a bad impression before eyes of law, hope your lawyer should have advised to you by now
