My marriage ended in a divorce by mutual consent around 7 years ago. I was forced to give up my rights to custody, guardianship and visitation in any manner for my son to get the separation. This was done under duress and high pressure blackmail tactics from former spouse in India, who refused to come back and live with me in USA and kept my son away from me. Signing this agreement seemed like the only way to get separation from her and move on with my life. My former spouse and I are living in different countries currently (India and USA). I plan to return to India.
However, I realize that the absence of a father is not healthy for the child and want to reestablish ties with my son. I do not want the child to grow up without a father and grow up hating the absent father. Is there any provision in Indian family law to reinstate visitation rights that I voluntarily gave up? First of all you need to approach the appropriate court and file appropriate petition to reclaim your rights to visit your son by stating all the facts and reasons for doing so. Then you can get your relief. Visitation rights cannot be absolutely taken away by some agreement. The relationship between father and child is eternal.
