From the facts stated, you have valid grounds to seek transfer of the divorce case to the place where you are residing, especially if you are a single parent, facing financial hardship, and have genuine security concerns. In matrimonial matters, courts generally give significant weight to the convenience and safety of the wife. You may file a transfer petition before the appropriate High Court or the Hon’ble Supreme Court, depending on the states involved, seeking transfer of the husband’s divorce case to your place. You may also request stay of further proceedings in that case pending disposal of the transfer petition. Further, you can place on record that your maintenance proceedings are already pending in your place and that compelling you to travel to another state would cause serious hardship. These circumstances strongly support your request for transfer and interim protection. Therefore, the proper legal course is to immediately move for transfer and seek interim stay, rather than continue appearing in the distant court at personal risk and expense.
