Regarding Maintenance and evidence

01-Apr-2024 (In Divorce Law)
hi! i filed for divorce and Maintenance in India after 10years of abusive marital life, and now seeking for interim maintenance and he is in US. After i filed for it they started skipping interim arguments from couple of hearings and suddenly he started sending every month little amount, is this to skip to get court orders for interim maintenance ? Also, will he provide happy emails which been sent 10 years back to him which was very initial stage of marriage at this maintenance stage to skip?

That's a smart move to show to the court that the Husband is a good and a caring person, even with out the orders the husband is paying some X amount to his wife and is willing pay extra Y amount if the court says so. You have nothing to worry. You can ask for the rightful maintenance through the Court. If you withdraw your petition then there is a 99% chance that your husband will stop sending you the money. He will make you to file a petition. Basically the husband will torture the wife through Court protocols. So dont back off now presuming he will pay. Get the amount fixed by the Court of Law. Claim your right legally. Happy Emails has nothing to deal with the maintenance now. You need not worry about those previous emails. Believe your intuition. Every now and then seek advices from other lawyers to get an understand the procedures and also you can make your lawyer feel that you aren't backing off and won't spare, if your lawyer is mingled with the opposite lawyer.
