Regarding interim maintenance order passed by dv court

15-Nov-2023 (In Divorce Law)
An interim maintenance order was passed under dv act. This order was appealed in the session court and the session allowed the appeal. I want to know as appeal is allowed then what does it means the order of the lower court has been quashed by the session court.

Hi there!

It is quite premature for an advocate to answer that query without seeing the order first. I would request you to share the same with me to make a comment upon the same. Though, it is pertinent to mention that the order passed by the Sessions Court is binding upon the lower court. For assistance, you may seek consultation from me.

You mean to say that an appeal filed by you against the impugned interim maintenance order of the Mahila Court has been reversed. To give our consider opinion we would like to legally peruse the contents of the order. You may seek a legal opinion from a lawyer

Dear client

In the above conspectus, as you mentioned that the sessions court has quashed the order of interim maintenance passed against you, would mean that the interim protection given by the family court has been quashed based on your petition. However, the case still remains active. Will have to peruse your case documents in order to advice you further.

Feel free to get in touch to discuss.
