Regarding divorce issue

Married for 8 years, one 4.5 year old kid. Daily fights, no understanding, strained relationship with wife family as well. No love, respect, loyalty for each other. Wife and her parents always say she and kid will live at their house etc. earlier child was small, but now he also have started understanding so I have made my mind for divorce, she refused, saying I will not go from your home. Please suggest what should I do to make her live in her parents house, and settle kid in new school etc.

Hello , as per your story it is retrievable broke down of your marriage due to direct interference of your wife’s parents. You have best option to send a legal notice to her for either contesting petition or mutual consent divorce by settling the custody of child through mediation proceedings. We feel that after 8 years of marriage there is lack of perfect cohabitation with each other and should settle all issues by approaching Court

In any case you cannot compel your wife to leave your house and stay at her parents house. It can only happen only if she wants to leave the house otherwise there will be allegations against you. In any case you are free to move ahead and file divorce petition in court. As far kid is concerned you can take admission in the school of your choice
