Query on application of passport for minor kid

My friend(male) has a kid who is 1yr old and the kid is born out of wedlock, mother of the kid is a divorcee, and she bore a kid with my friend through illegal relationship. The kid has birth certificate as my friends name as father. Now when the kid applies for minor passport will the birth certificate be valid?? My friend is not the husband of the divorcee, he is only a biological father of the kid and has his name on the kids birth certificate.

Dear Sir, If the passport authorities dig into facts then it will be problem. Because the date of divorce gives an hint that after divorce that child cannot be born to her ex-husband and the child cannot be a legal child through her ex-husband.
