Query about settlement procedures.

MHC directed us to report our settlement on next hearing since the situation now is this. Myself filed divorce petition under adultery and cruelty ground. She filed 498A and DVC cases against me which are false cases. Now she filed HMOP transfer petition. Girl is not agreed for out of the court settlement. But MHC justice directed us to appear on next hearing with settlement report. She is holding my 9months baby. Now for the settlement, I have few LIC deposit bonds and bank FD bonds in my child name which are all with maturity term in 20yrs and 15 yrs. Can i give those bonds and compensate with settlement amount? Will the court accept such bonds? Kindly advice.

In this case, a mutual settlement between you and your wife decision court never involve but she filed DV against you court maybe order and further normally bonds won't consider FD will consider. I have a vast practice in that area you can seek my assistance in your matter.

Court cannot force you to go for settlement. Even if you provide those bonds you cannot be sure that she will accept the same. Settlement means to sort out the issues between you two. It is better to contest the case and let your wife come for an amicable solution. Otherwise she will make unreasonable demands.

Hi, You said you've filed divorce on the grounds of adultery and cruelty. Filing divorce on adultery ground is like using a double edged sword. My questions are: 1. Are you sure that your spouse involved in adultery? 2. Do you have valid evidence to prove your averment? 3. When did you come to know about your spouse's affair? 4. When did you file divorce? 5.When did she file 498a and DVC cases? 6. where you both put up? 7. Have you sought for DNA test for the girl baby?
