Quashing of fir 498A which filed against me
23-Jun-2023 (In Divorce Law)
i did a court marriage on 01 july 22. then we went to haridwar and on 02 July we visited rishikesh and on 03 we came back to meerut. on 04 july i rejoined my duty in Guwahati. and she went to her home on she filed 498A case under 156 crpc. what can I do for quashing of this fir or how much chances are there for quashing if I go in high court
First of all rather than going legally you should serve her a legal notice to figure out what's going on in her mind regarding you. After that if he fails to give you a satisfactory reply then you have to approach the court under section 9 (RCR) for calling back your partner in your matrimonial life. For more legal assistance I am just a call away.
quashing of the fir will depend upon the gravity of allegations in the fir, and supporting evidence given by your wife in the fir. if it's a good case for quashing, there are chances that the court may insist on some payment to be made to the wife. however if it's absolutely bogus case, chances of payment to be made to wife are negligible, since the marriage was not a long one.
