Both the husband and wife apply for Mutual Consent Divorce in a joint petition. Terms and conditions like permanent alimony and child custody are clearly mentioned in the Petition and signed by both parties. The husband and wife are also required to submit their Marriage Proof, Identity proof, address proof and photographs. The husband and wife are required to personally appear on the date of admission of the case. They are also required to appear personally on the date of conciliation and on the date of recording of evidence. If the husband and wife are living separately for a continuous period of 18 months or more then a waiver application can be filed to waive out the statutory 6 months period.
