Procedure if Husband has given notice fr divorce

I m Hindu. married 13 yrs back ...two kids....I used to chat with one of my classmate 2 yrs back.that classmate showed interest in me ....I took 2-3 screenshots of that chat just to show my best friend that he talks these things to me.after that I stopped chatting with him.8 months back my husband got those screenshots some how ...he beaten me up from 2 hrs. I apologised so many times to him n my inlaws....he circulated all those chats to each family member...taken my mobile n I pad which was a gift frm my brother...flew away with my kids....after that I also left home ....but smhow after so much efforts of mine he called me back...but continue to drink n breaking of things n abusing in front of children. ..I was so scared that I had to call police but not lodged fir...he is so egoistic that after this police matter he he sent a notice of divorce.smhow that also settled...but now he is nt talking to me...always warn me ..mentally torture.

Dear client if u can want u can file complaint with women cell of police against husband for physical and mental harassment. U can also file domestic violence case in court against husband and his family. For any legal help call me

In the situation mentioned by you... You need to decide whether you need to go on with your marital relationship.
In case you decide to continue your marital relationship, these are the legal option for you :

a) First and foremost you need to reply the notice of Divorce,
b) You may file a police complaint for harassment against your husband
c) You may file application under Domestic Violence Act seeking maintenance and protection in the matrimonial house

In present circumstance, if you decide to go for Divorce

a) You can claim custody of your children (in case he is not looking after them)
b) You can claim maintenance for your self and your child from your husband

You have made lot of serious efforts to settle you dispute and restitutute your relationship. If you wish to continue with your approach then file petition for Restitutute of Conjugal Rights and you can also duke am application for maintenance. You have lot of options which can be discussed personally.

Dear Querist You are now lying in between. The facts you have mentioned are now having a drastic en. You now have to take a firm decision whether to continue the marriage or to end the same. You have to discuss this with expert.
