Possibility to win a TR CMP based on Physical Disability

My wife has filed a TR CMP in Madras High Court to transfer the divorce case from Chennai to Karur. I am a physically challenged person (OH). Is it possible to win against the appeal made by my wife based on my Physical Disability to continue the case in Chennai itself. I have 2 children. 1st son is 4 years old & 2nd is 6 months old. They are with her in her in Karur. Divorce case was first filed by me on the grounds of cruelty. I am a hindu.

Yes...If you are a physically challenged person, the high court will definitely consider...in most of the transfer cases, generally the high court will see the inability of wife..I think that your case is somewhat different and so the high court may give a favourable order in your case.

yes sir, the Hon'ble Highcourt will or may consider if the disability of the husband is genuine. there may be different opinion on this. the Hon'ble Highcourt may pass considering your disability and also it will consider the wife side. it depends on situation. we can also produce the medical certificate. on the contrary your children's are with your wife. so it would be difficult to ascertain now about chance of winning your case.
