physically seperated since 2009 and now want to make it legal

i have physically seperated from my huband since 2009 due to his alchoholic behaviour andnphysical abuse.Now i want to legally seperate from him.We have a flat which is jointly owned by us .I want it to be sold and the proceeds to be legally distributed.I have a daughter and bringing her up on my own.

You can file for mutual divorce if your husband is ready for the same but if you are sure that he won't agree for mutual divorce then you can file the divorce on the basis of mental and physical cruelty and claim maintenance also

You may file for mutual consent divorce if your husband agrees for it. if he does not agree for Mutual consent divorce then you have to file for contested divorce and you can also ask for maintenance and other reliefs like getting your share in the said jointly owned flat through court.

The above flat can be sold or assignment deed from husband in your favour can be done which will give you full ownership. For separation you have to file divorce petition before family court and you can get separated from him.
